These Terms and Conditions (“Terms”) form a legally binding agreement between you and Oliver Porcher Programmierung (“Company”, “we”, “us”, “our”) regarding your access to and use of StreamUltimate.gg and related services (collectively, the “Services”).

By using the Services, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not use the Services.
We may update these Terms from time to time. Changes become effective when published on this page unless otherwise stated.
StreamUltimate.gg is a platform where users can upload custom card designs, collect cards, and earn virtual points through Twitch watchtime activity. Card uploads are publicly displayed and can be collected by other users.
The Services may not be legal in all jurisdictions. You are responsible for complying with laws applicable to your use of the Services.
Unless otherwise stated, we own or control the intellectual property rights in the Services, including software, design, branding, and platform content (excluding user-uploaded content).
You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use in accordance with these Terms.
By using the Services, you represent and warrant that:
You may need to register to access parts of the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Some Services may require payment. You agree to provide current, complete, and accurate payment and account information. Prices and availability may change at any time.
We may correct pricing errors and refuse or cancel orders where permitted by law.
Users may earn virtual points through Twitch watchtime tracking and related reward mechanics. These points are digital reward units within the platform only.
You may stop using the Services at any time. If you maintain a paid subscription or recurring service, cancellation terms presented at checkout or in your account settings apply.

The Services allow users to upload and submit user-generated content (“UGC”), including images, graphics, card names, and descriptions for custom card designs.
By uploading UGC, you represent and warrant that:
Uploaded cards are publicly visible on the platform and may be collected by other users. Users retain ownership of their original designs, subject to the license in Section 9.
We are not liable for user IP infringement or other unlawful user content. Users are solely responsible for the content they upload.
If you are a rights holder (or authorized representative) and believe content on the Services infringes your rights, send a notice to support@streamultimate.gg including:
We may remove or disable access to reported content while reviewing claims. If content was removed in error, the affected user may submit a counter-notice with supporting information. We may restore content where legally appropriate.
We may suspend or terminate accounts of users who repeatedly infringe intellectual property or repeatedly upload unlawful content.
By uploading UGC, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your uploaded content solely as required to operate, provide, and improve the Services (including public display and in-platform collection features).
You retain full ownership of your original content. This license ends when you delete the content or your account is deleted, except that backup/cached copies may remain for a limited period and as required by law or technical necessity.
We are not liable for any user contributions and do not endorse user content by hosting it.
If review or rating features are available, your feedback must be truthful and based on actual experience. We may remove reviews that are unlawful, abusive, misleading, or unrelated.
The Services may link to third-party websites or content. We do not control and are not responsible for third-party content, policies, or practices.
We reserve the right to monitor the Services and take appropriate action against violations, including removing content and restricting access.
Our Privacy Policy explains how we collect, use, and protect personal data. By using the Services, you acknowledge and agree to the Privacy Policy.
These Terms remain in effect while you use the Services. We may suspend or terminate your account or access at our discretion if you violate these Terms or applicable law.
We may change, suspend, or discontinue all or part of the Services at any time. We are not liable for downtime or discontinuation, subject to Section 20 and mandatory law.
These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law rules and excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection law provides otherwise.

We may correct typographical errors, inaccuracies, or omissions in Service content at any time.
The Services are provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes or limits liability where exclusion is not permitted by law.
In particular, under German and applicable EU law:

These Terms and any referenced policies form the entire agreement between you and us regarding the Services. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.
